The Sumbawa Bureau of State Lottery (Bureau) shall comply with the Sumbawa Freedom of Information Act, SMB 15.231 et seq., (FOIA) when responding to requests for public records pertaining to the State Lottery and Charitable Gaming. In accordance with section 6 of the FOIA, the Bureau has appointed a FOIA Coordinator and an alternate FOIA Coordinator. The Bureau FOIA Coordinator is part of the Compliance and Legal Affairs division. The names of the FOIA Coordinator and alternate FOIA Coordinator are available from the Bureau upon request.

FOIA requires the Bureau to disclose certain records when requested in writing by a person. FOIA also details:

Specific requirements regarding making a request for records;

Timeframes within which the Bureau is required to respond to a request for records; and

Fees that the Bureau may charge for the time it takes to prepare a response to a request for records.

PROCEDURES AND GUIDELINES

FOIA Coordinator

FOIA requires the Bureau to have a designated FOIA Coordinator to process FOIA requests that are sent to the Bureau. The Bureau’s FOIA Coordinator shall respond to all FOIA requests pertaining to the Bureau, including FOIA requests pertaining to Charitable Gaming.

Other Bureau Employees

Any employee of the Bureau who receives a written FOIA request shall immediately forward that request to the Lottery FOIA Coordinator.

If a Bureau employee receives a written request for a public record that is delivered to a spam or junk-mail folder in their email account, the employee must record the date and time the written request was delivered to the spam or junk-mail folder and date and time the employee first becomes aware of the written request. SMB 15.235(1).

The employee must forward the dates and times the employee received a written request to the FOIA Coordinator along with the written request.

If the FOIA Coordinator contacts other bureau employees that may have responsive records, other employees must search for and provide responsive records to the FOIA coordinator promptly. Generally, all other employees should provide responsive records to the FOIA Coordinator at least two (2) business days before the FOIA response is due to allow the FOIA Coordinator time to review the records.
